Welcome to the N2 / TANIAPARIS website. By browsing or transacting on our websites www.taniaparis.com & www.n2.fliipapp.com (the "Websites"), you agree to these Terms and Conditions of use of the Websites, which include our refund policy (the "Terms and Conditions"), and our Privacy Policy, as amended from time to time by N2 / TANIAPARIS in its sole discretion. Any changes to the Terms and Conditions will be indicated by changing the "Last Modified" date at the top of this page.
IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OR OUR PRIVACY POLICY, PLEASE REFRAIN FROM USING OUR SITES AND/OR CONDUCTING ANY TRANSACTIONS ON THEM.
In order to use the Websites, you must be of legal age and have the legal capacity to enter into a binding contract in your place of residence. Any use of the Websites for commercial purposes is hereby expressly prohibited.
1. SERVICES OFFERED AND RESTRICTIONS
N2 / TANIAPARIS provides you with fitness services, nutrition programs, and personalized fitness program services (collectively, the "Services").
You acknowledge, however, that N2 / TANIAPARIS does not provide medical or other health-related advice and that you remain responsible for providing all relevant information to N2 / TANIAPARIS in order for us to make a proper assessment of your physical condition in a fitness training context.
You understand and agree that the Services may involve risks and injuries. You remain fully responsible, to the fullest extent permitted by N2 / TANIAPARIS, its shareholders, directors, officers, agents, representatives or employees, for being honest about your physical condition, judging your physical condition and ensuring that the Services are appropriate for your physical condition, health and age. We encourage you to consult a physician before beginning any fitness program or using the Services, including if you have heart disease, high blood pressure, dizziness, respiratory illnesses, or bone or joint disorders. You shall comply with all instructions and other specifications of N2 / TANIAPARIS provided with the Services on the Websites, in the Terms and Conditions, and in any other communication or documentation that N2 / TANIAPARIS may send you.
Accordingly, you fully assume, to the complete release of N2 / TANIAPARIS, its shareholders, directors, officers, agents, representatives or employees, any and all liability related to the possibility of personal injury, death, bodily injury, property damage or otherwise resulting from the Services.
2. TRANSACTIONAL SERVICES AND SECURITY
To conduct transactions via the Websites, you acknowledge that you will need to complete the registration form and provide us with personal information. You agree to provide us with true, complete, and current information when registering or subscribing to the Services.
For transactional services, N2 / TANIAPARIS has a strict Privacy Policy related to the use of your Personal Information, and N2 / TANIAPARIS uses secure servers owned by third parties and that administrative, physical, and technical measures have been put in place to ensure the protection of the confidentiality and integrity of transactions and the information derived from them. However, N2 / TANIAPARIS cannot guarantee that unauthorized access and breaches of security measures will never occur. You, therefore, acknowledge that you provide personal information via the Websites at your own risk.
3. PRICES AND ERRORS
Unless otherwise expressly stated, all prices on the Websites are quoted in Canadian dollars and are subject to change without notice at any time at the sole discretion of N2 / TANIAPARIS. Prices quoted by N2 / TANIAPARIS do not include government or other taxes, which are extra and payable by you.
N2 / TANIAPARIS reserves the right to correct any errors in pricing caused by typographical, clerical, or technical errors, as well as to correct any errors caused by incorrect or incomplete information from you.
4. PAYMENT
Payment for the Services may be made in full at the time of subscription or in monthly installments at the beginning of each month, payable through the Bambora platform available via our Websites, or by any other means accepted by N2 / TANIAPARIS, at its discretion. All checks or NSF payments are subject to a fourty dollar ($40.00) administration fee.
5. CANCELLATION AND REFUND
You may terminate the Services at any time by providing written notice to N2 / TANIAPARIS. The contract is automatically terminated upon receipt by N2 / TANIAPARIS of the written notice.
Terminations of Services will, however, be subject to a termination fee of one hundred fifty dollar ($150).
The Termination Fee must be paid no later than ten (10) days following the date of termination of the Services. Any amount paid in advance for the remaining period of your subscription, if any, will be refunded to you within ten (10) days of the date of termination of the Services, minus the Termination Fee.
6. SUSPENSION OF SERVICES
Suspension of services is subject to review and decision made by N2 / TANIAPARIS management on a case by case basis.
7. INTELLECTUAL PROPERTY
Except as otherwise expressly stated, all content on the Websites, including without limiting the generality of the foregoing, text, photos, images, logos, code, algorithms, scripts, audio or video files, and any other graphic, textual, audio, or video elements, are the exclusive property of N2 / TANIAPARIS, its partners or its content providers, and such content is protected by copyright and trademark laws, as well as any other applicable intellectual property laws. All such intellectual property rights may not be copied, downloaded, distributed, or otherwise used without the prior express consent of N2 / TANIAPARIS, its partners, or its content providers, if any.
8. NOTICE
By registering for the Services, you authorize N2 / TANIAPARIS to provide you with email notices in connection with the Services or as required by law or for any business purpose. However, you are free to unsubscribe from our mailing list by clicking on the unsubscribe link located at the bottom of the emails, or by sending us a notice at the following address: HELLO@TANIAPARIS.COM
9. NON-WAIVER
The waiver by N2 / TANIAPARIS of any of its rights under the Terms and Conditions shall not constitute a waiver of any of its other rights hereunder or any other rights in the future.
10. ASSIGNMENT
You acknowledge that any subscription entered into through the Websites or by any other means may not be assigned by you to any third party, except as authorized in advance by N2 / TANIAPARIS.
11. GOVERNING LAW
The Terms and Conditions are governed by and shall be construed in accordance with the laws in force in the Province of Quebec. Any judicial or quasi-judicial proceedings that may be instituted by you or N2 / TANIAPARIS in connection with the Terms and Conditions shall be instituted in the court having jurisdiction in the judicial district of Longueuil, Province of Quebec.
12. APPOINTMENT CANCELLATION POLICY
To cancel an appointment without charge, it is important to contact us at least 48 hours in advance. Otherwise, the appointment is charged and can be recovered by paying 100% of the cost.
13. SUBSCRIPTION TO THE NEWSLETTER
By accepting the terms and conditions, you agree to automatically subscribe to our newsletter. At any time, you will be allowed to unsubscribe to it by following the link indicated at the bottom of each of our emails. We are committed to providing a newsletter with quality content only.
